Stop This Horrible Mental Health Bill by Contacting Your US Senators Now!

Last month, 6 July 2016, the US House quietly and overwhelmingly (422 to 2) passed the worst piece of mental health legislation I have seen in my 42 years of human rights activism. HR 2646 is sponsored by Rep. Tim Murphy (R-PA) and is mis-named the “Helping Families in Mental Crisis Act of 2016.”

This month of August, you can stop this frightening bill by contacting both of your US Senators. In fact, I would encourage you to also contact Sen. Bernie Sanders (D-VT), because he has shown signs over the decades of supporting our revolution in mental health care. Of course, you may contact Bernie wherever you live in the world.

First, I will try to briefly explain this bill and the main reasons I oppose it. But you, dear reader, will I hope take action and contact US Senators, because we only have weeks to turn this around!

Why We Must All Act Now To Stop This Bill!

Rep. Tim Murphy is the only psychologist in Congress, today. His enormous and expensive bill is supposedly a response to mass shootings, but incredibly the Committee in the House that debated this legislation continued a multi-decade US Congressional ban on even studying or researching gun violence!

There are many bad parts to this bill, but just two that I would like to highlight are:

  1. It is disempowering! This bill would oppose the voice of mental health consumers and psychiatric survivors. The historic trend for the past few years has been to support the empowerment of mental health clients, but this bill, which is more than 100 pages long, excludes the perspective of the citizens directly impacted by mental health services.
  2. It supports forcibly drugging Americans in our own homes! The worst part of this bill, is that it would extend Federal grants for involuntary psychiatric treatment of American citizens directly in our own homes. Almost all USA States have passed such involuntary outpatient commitment laws, but these IOC laws are not used as much as fanatic tyrants would like, so this bill — supposedly by a “small government” Republican — gives taxpayer money to make sure Americans take our court-ordered psychiatric drugs while at home. This forced drugging is why I call this approach the “Bill Cosby School of Mental Health.” Seriously, this is chemical rape.

During the rest of this month of August, 2016, the disability movement is urgently asking you to contact US Senators to stop HR 2646 from contaminating a bill being considered by the Senate, S. 2680 “Mental Health Reform Act of 2016.” Some Congresspeople are trying to sneak in oppressive amendments from HR 2646 into S. 2680.

Senator Ron Wyden Has a Personal Connection to Mental Health

It is not well known, but the only sibling of Ron — Jeff Wyden — at first had a promising start in Stanford University, but at the age of 21 was diagnosed as schizophrenic. Before his early death, Jeff Wyden was to experience three decades of intense mental health treatment, including involuntary drugging and even involuntary electroshock.

The parents of Ron and Jeff were remarkable. Mother Edith, born in Koenigsberg, Germany, fled the Nazis at the age of 16. Father Peter, born in Berlin, Germany, fled the Nazis at the age of 13. Both parents began their free lives here in the USA. Peter became a journalist, and one of the ways Peter addressed his profound feelings involving the mental health system, was writing a book that was published in 1998 about his son, Jeff. I read this book when it was published, and frankly there was a lot of it with which I disagreed. For example, the author seemed to know a little about our psychiatric survivor social change movement, but I did not perceive a level of deep curiosity about us, but instead I felt some unfair criticism.

However, I know that there are very deep things going on with the human mind, and everyone deals with these difficulties in a variety of ways. A few months after Peter published what was to become the last of his one dozen books, he died of a stroke and subdermal hematoma at the age of 74, possibly related to a head injury he received upon bumping his head when exiting his car, according to his family.

Peter’s son Jeff also died, soon after his father, in 2002 at the age of 51, after living in a halfway house in San Jose. The main article I found about the death of Jeff Wyden said the cause of his death was not yet determined at the time of publishing.

Of course everyone’s life is far too complex to sum up, however, as a psychiatric survivor myself, who was also first diagnosed schizophrenic as a young adult inside a psychiatric institution while attending a prestigious college, I know that the trauma experienced by Jeff must resonate to this day with the whole Wyden family.

Over the decades I have had a few chances to talk with Senator Wyden both in Eugene and at his Senate office. He started his career as an activist for senior citizens, so I have always had hopes that he would support the goals of our social change movement. For example, during our work on electroshock, his office helped to prevent the rubber-stamping of the device by the FDA.

I have checked with an attorney, and though this might not be believed by the average person, Rep. Tim Murphy’s awful bill can be used for not only forcibly drugging, but court-ordered involuntary outpatient electroshock. Yes, I realize that the vast majority of involuntary psychiatry is about drugs. But once in a while, involuntary outpatient commitment has involved electroshock. For real! To research how this monstrosity has happened on the state level, please direct your search engine to these phrases:

Dear Ron and any staff work on disability or mental health:

Over the decades, Ron, we have met a few times, mainly here in Eugene and once in your in your Senate office. But you meet so many thousands of people, let me please sum up my 60 years:

I am a psychiatric survivor. I was diagnosed schizophrenic, locked up in a psychiatric institution several times, but recovered enough to spend my whole life working to improve the mental health system.

Ron, this is the most important letter I am writing to you!

You see, I feel that the US House has made a severe mistake a few weeks ago. Yes, they were well-meaning when they passed HR 2646, for mental health reform, but there are elements in there that make this among the very worst mental health bills I have ever seen! Please pass the Senate bill 2680 without the amendments from HR 2646, also known as the Murphy Bill.

Ron, the reason that I started this work about 40 years ago was that back then I was a working class kid from Chicago going to Harvard on scholarships. I ran into difficult times, and five times I was placed in psychiatric institutions, with diagnoses such as schizophrenia, clinical depression, and bipolar (then manic depression).

Thankfully, Harvard referred me in my senior year as an intern in the human rights social change movement led by other psychiatric survivors. I graduated with honors from Harvard in 1977, and I learned about community organizing and mental health. This became my career.

While I am retired now, I have spent my whole professional life as a human rights community organizer in mental health. For 25 years I directed MindFreedom and it is one of the main independent human rights groups in mental health.

The reason I am sending you and your staff this important, urgent message. It is important that you pass Senate Bill 2680, without the amendments from HR 2646. Specifically, since you are so busy, let me focus on two points:

  1. We in the disability movement have a unifying slogan: “Nothing about us without us!” Yet, HR 2646 silences the voices of people who have real-life experience with mental health issues. The trend in mental health, internationally, is for more empowerment. However, HR 2646 actually muzzles citizens with psychiatric disabilities from speaking up in our agencies!
  1. HR 2646 gives away precious taxpayer money through grant funding for what is mistakenly called “Assisted Outpatient Treatment.” This is actually forced psychiatry, usually forced drugging but sometimes even forced court-ordered electric shock. Can you imagine? There is no evidence that outpatient commitment is more effective than voluntary care.

Ron, of course I read your father’s book. Since this topic has impacted my whole family for some many decades I know this can be a controversial topic for many people.

As community organizers, we know that power can be used to silence or amplify people. Groups run by mental health consumers of course have many opinions. But there is unity when it comes to opposing HR 2646!

Please, oppose the amendments from HR 2646, and support S. 2680.

More than 42 Months After I Broke My Neck, I Do a Stand-Up Comedy Act this Saturday, 30 July 2016

Or perhaps I should say “sit-down comedy”? My intro for my act by the MC will be this:

“From right here in Eugene, our next sit-down comic is David Oaks, also known as PsychoQuad. That means he can slay any audience and then plead insanity!”

If you live in the Eugene-area, or know someone here, get there early to save your seat at Sam Bond’s Garbage, the bar Blair! I will bring my own seat. The monthly show, Bleepin’ Funny, is hosted by an indisputably leading comedic talent in our area, Leigh Anne Jasheway-Bryant. And it is a free event.

I have been going with my loving wife, Debra, for most months to Bleepin’ Funny, for years. I have been in the audience, in fact Sam Bond’s saves a table or two for my friends and me. But this Saturday, 30 July 2016, when the show starts at 5 pm, I am slated to take the stage about the fourth slot.

I have been practicing my stand-up. Before my fall I had the disadvantage of speaking “seriously” in about a dozen countries, for a fee. But humor is better and more fulfilling than boring non-stop seriousness. Or not?

Today, 27 July 2016, above we scoped out the stage at Sam Bond's, where I am to perform this Saturday. I have two plans for getting on the stage. They involve four strong, sober volunteers with strong backs. I will bring a hold harmless clause printout so they will not worry about lawyers. But should I wear a bike helmet?

Bleepin’ Funny always features some stand-up, plus Leigh Anne takes the stage with a crew and does some lively, fresh improv. The show ends about 7 pm. It is all-ages, so bring the kids and do not worry about blue material. Call me crazy, but, I say get there early. Heck, even if it is nearly empty you might volunteer for my chair-hoisting crew! See Ian if you want to help out.

The comic Isaac Paris drew me to this amazing possible career, if these weird people known as stand ups can tolerate a professional weirdo. Move over Josh Blue, you no longer are the king of cripple comedy.

Isaac helped arrange for me to do comedy and be on this show. He is up in his native Alaska this week, so he will miss this Bleepin’ Funny. My documentarian and good friend David Zupan plans to video my act, with permissions of course!

Last week, I rehearsed at the Lane Independent Living Alliance (LILA) Peer Support Club, and Zupan was out of town so I did not pursue the documentary. But a relative shot me with their laptop for my own edification. You would think we had somehow violated the law, because an unsmiling employee had her boss e-mail me a verbal unfriendly terse note, I guess government-funded places like that can never have documentaries? My friend Mark Roberts is the brother of the famous Ed Roberts! I guess if Ed were still alive, and tried to speak at a Center for Independent Living, he would not be able to be taped for broader distribution. Hey, protect those privacy rights, cash our taxpayer-money checks, and let us celebrate there are now several-hundred Center for Independent Living (CIL’s) in the nation today, the backbone of the USA disability movement. I love CIL’s, but it is time to start an ADAPT local chapter; I hear you ADAPT headquarters in Austin, Texas.

Humor is Necessary: Please Laugh Once Per Minute (Just Joking!)

Anyway, the good humor, at least we hope it is good humor, will be at Sam Bond’s Garage, a down-home community center with good beer, great little menu, and even great outdoor seating in the back during warm months when it is appropriate. See you there, I will get there very early to save a place or get drunk.

Some Actual Real Humorous News! Well, True Anyway, and I Think it is News-Worthy Mental Health Revolution News

During my rehab, over these more than 42 months, I have had one (1) paid gig doing my work. Incredibly, probably because of a recommendation by my good friend, psychiatric survivor New Yorker Celia Brown, of MindFreedom, my solitary paid gig during my rehab has been to be one of the many independent contractors in the mental health reform field to review and comment on drafts of several manuals, mainly about mental health peer support, by the World Health Organization (WHO), based in Geneva, Switzerland.

The WHO, yes, the same global health agency that tackled some nasty viruses in recent years, has a small but active division working for global mental health. Five years ago, I had the good fortune to visit WHO headquarters in Switzerland, because a number of us psychiatric survivor activists met with and consulted for the head of WHO mental health at that time, the passionate and brilliant Italian psychiatrist, Dr. Bendetto Saraceno. The doctor now directs a psychiatric non-governmental organization in Europe, and has retired from WHO.

This year, the WHO mental health manuals have not yet been released to the public, and so the content is private. However, for my generous independent contractor fee, I tried to provide online input for all the draft manuals. I tried to provide written comments that were both practical and revolutionary.

Some of the non-normal written comments that I made about these drafts, as an actual official paid WHO consultant, were:

  • The world very much needs a revolution, especially because the climate crisis has been so ignored for too many years. Yes, as the Pope recommends, I also suggested revolution for our planet in my official written comments to WHO, as a contracted consultant. In fact, since another round of input is to be requested, I currently still am an WHO independent contractor. Of course, I am speaking for myself and my opinion alone here, not in any way for WHO.
  • Repeatedly, I made sure that my position was crystal clear, that one hundred percent of all people, all the time, every moment, from womb to tomb, are in a state of mind that is in extreme, life-threatening crisis. That is right, my 42 years of activism in psychiatric survivor revolution provided me with four words as my lesson: “We are all nuts!” Nothing wrong with being nuts, if that word has any meaning at all. We may always all of us be nuts, but we can choose what kind of nuts we will be. Will we be creative positive nuts? Or destructive divisive nuts? We must choose.
  • Everyone alive, everyone, has a crisis. Maybe your’s will be very short, but we all have at least one crisis. We are moral. We love. So, prepare for your crisis! Hey, all you need to do is get ready for the unexpected. May I humbly suggest building your community of friends and family?
  • We must act now! We cannot wait for perfect information, in fact science has a theme: Mystery! Whether it is quantum physics, black holes, fractals, chaos theory, string theory, dark matter, dark energy, etc.: As Socrates noted over and over, we do not know much, to this day. But we still need to act, we still need to ask questions. Just as the wing of a butterfly can later influence the course of a hurricane, we must flap our wings! Note we have enormous influence, but not control.
  • The other side of the Butterfly Effect is that as the climate crisis triggers dozens of positive feedback effects, we are entering unpredictable chaos. No way I am giving up hope! Hey, that was me lying on the floor with a broken neck 42 months ago! But my paralysis is mild next to our society’s paralysis. Everyone, all of us, get off the floor!
  • A first step is to realize that internal revolution in our hearts and minds, is not stoppable. Let us make this shared goal more visible now, to help our global morale. I am not saying we will win a quality revolution, but I am sure we can try right now! I believe in you, you all are Supreme Commanders this time! OK, not all of that went into my comments to WHO.
  • But, I made it very clear in my written comments to WHO as an official consultant, that the thing we the public have been calling “normal” does not actual exist. Yes, like some horrible nightmarish virus, “normality” has been eliminated, it does not exist. Since I know that several WHO people have a great sense of humor, it turns out they are human, then I hope they take some credit for finding their funny bone and realizing the seriousness of saying, “There is no normal!”
  • Yes, normal is not in fact, well, normal. Eliminating all traces of “normal” is not the same thing as going after a virus. Yes, some people choose to take drugs to address mental and emotional issues. That is their choice. But “normality” and mental wellness in general, is about something far deeper and more profound than any “normal” medication.
  • I encourage folks to use the easy online interface with WHO to provide resources, suggestions, feedback, important points about the mental health industry, and more important the revolution in mental well being, which uses choice/freedom as a kind of umbrella for recovery, and once shielded there are thousands and thousands of approaches! Just use your search engine to search for the following phrase and then type in your comments: World Health Organization Contact Form. Dr. Saraceno told me, that every comment made to WHO must be treated with respect, and logged. Yes, even so-called irrational comments. Please send your favorite empowering alternative, ask WHO to send this to their mental health division! At the bottom of this is a three-minute video to promote reaching out to WHO. The revolution does not apply only to us consultants, but to everyone, even non-human animals, plants and maybe every particle.
  • Hey wouldn’t it be cool if the whole universe, you included, are equals all working as one? Now that is a Revolution!

On the Birthday of My Friend Leonard Roy Frank (LRF) 15 July 2016

I first wrote this on the 8th day of Creative Maladjustment (CM) Week, which was 7 to 15 July 2016. Yes, Creative Maladjustment Week is now eight days long to end on the 7/15 birthday of this psychiatry-surviving, electroshock defying, mystic-being, beatnik-pioneering, quote-editing San Franciscan Leonard Roy Frank (who would have turned 84 this year of he were still alive).

During these three and a half years of my deep recovery I estimate that I have listened to more than 4,000 hours of National Public Radio news, tuning in every morning via our local KLCC-FM. For example, I feel as if I am personal friends with John Hockenberry, host of Takeaway, because he first got his start here in Eugene KLCC-FM, he is in a wheelchair, but he only exchanged one message before he moved to the East Coast and became a national radio star. He still seems to support revolution, and you do not have to use your imagination much to hear that.

So, for better or worse, I have had more time to think, with my brains, heart, great support folks. Leonard, you showed us that after incredible torture the human spirit can still come back and help humanity. Every time I spoke privately with Leonard, we laughed and laughed. What a keen and at times wicked sense of humor, informed of course that near-biblical personal moral code.

A bunch of my friends in our movement are now dead, or as some of us joked very, very disabled: Rae, Judi, Howie, so many more, and now Pat Risser. If we remember to reform the corrupt mental health group, NAMI, even half as much as Pat wanted, always keeping our sense of humor and outrage, think of all the loving parents who we can support, now being tricked by this drug company front group!

Leonard lovingly edited this book of thousands of quotes, and subversively inserted dozens of great quotes very critical of the mental health industry, psychology, psychiatry, electroshock, etc. While he did not hide his identity as a psychiatric survivor during his work as one of the world’s experts on quotes, the fact is that he ended up gathering quotes as part of his strategy to re-create his incredible mind after psychiatry tried to destroy his loving spirit, unsuccessfully.

Sounds like LRF got the last laugh on the mental health industry torture machine. Since this apparatus apparently lacks a spirit of humor, getting the last laugh may be very winnable! I know that so many people have been cheering me on and sending support in so many ways, thanks! My Mom used to send out personal thanks with hand-written cards. As Mom got into her late 90’s she stopped sending cards. Her death last year really put a crimp in her card writing!

But do MindFreedom members really know that this shy Mom of mine worked for years as a volunteer in the main office, sometimes three days a week! Truly, Violet Oaks, my Mom, was MindFreedom’s top volunteer. So far.

For those of you who have read this long post, despite my many severe disabilities, or perhaps because of my creative maladjustment to these extreme challenges, I am talking with board members about coming back in some way, perhaps as a consultant. If I can crawl back to the work place, with extreme accommodations, so can anyone!

So a MindFreedom folks, do you want me back helping on our ship after these 42 months? If you can work together with other members, and ask me to come back, maybe I will, in some way. Before I fell, during my 25 years at MindFreedom’s helm, I raised about one million dollars for this grassroots human rights coalition.

  • Everyone will experience disaster, probably more than one disaster, because after all we are all mortal.

How did I go from lying alone with a broken neck in my writer’s study, alone, to leaving the emergency department more than 42 months ago with a big smile? I’m still working on answering that myself. Is it because I fell the same month as the end of the Mayan calendar, December 2012? Maybe it is. Maybe this is a fulfillment of prophesy. Or is it? The main thing I know is that I have a lot of you to thank! Breaking your neck is never a good idea.

But if you must break your neck, I would recommend Eugene, Oregon, USA. I have so very many of you to thank! Surprisingly, the absolute winners in the “Support David W. Oaks During His Recovery,” is the Fair Family connected to Oregon Country Fair.

And this is far beyond OCF, far far beyond festivals seen Bloom documentaries, maybe the whole universe beyond!

My Operation Tomorrow: Mental Health Justice, Speaking Out for Our Rights, and Creative Maladjustment

In a few minutes, I head up to Portlandia with my darling Debra, to get my throat slit tomorrow.

Do not worry, I have not been captured by ISIS for a beheading. My throat operation to insert a Gore-Tex  little implant in one of my vocal folds to help me, hopefully, be louder. For the past 42 years I have been a psychiatric survivor, and in the last few decades I have seen how working with the disability movement can amplify our voices.

Three-and-a-half years ago, I broke my neck in an accident, involving our cat, Bongo, really! Because of a pre-exisiting condition and complications, I ended up with not just a power chair, the new status of quad, but also about ten other disabilities, but who is counting?

I never expected the idea of trying to find my voice to become so literal!

And with good results, I hope to contribute my voice to Creative Maladjustment Week, which begins in two weeks, Thursday, July 7. This year the celebration week will become eight days long to include the birthday of the late psychiatric survivor, author, and friend, Leonard Roy Frank, July 15.

So what will be my first words after surgery? A documentary film maker David Zupan, another good friend, will be there to record it. I do not expect I will be as articulate as the late Charlie Chaplin, below, but you can enjoy him as he sums up what I would like to say!

Dear Supreme Commander (You!):

Did you know you are a key leader of a global peaceful revolution? Surprise! My guess is that many of you reading this may not yet know that you are one of the “Supreme Commanders” of  world revolution.

In fact, if you wish, and you reflect the values of Martin Luther King, you may say you are leading the organization that he first envisioned, International Association for the Advancement of Creative Maladjustment (IAACM.)

Let me explain.

Yes, during World War II, Dwight D. (Ike) Eisenhower was the Supreme Commander during D-Day, which was one of the biggest operations in human history. This time, we need to do something far bigger than D-Day, encompassing the whole world. You and everyone are Supreme Commanders.

So I have a question for you:

“What does it look like if humanity even begins to attempt a global revolution?”

Presidential Primary & Forced Outpatient Psych Drugs

This month, May 2016, the candidates for USA President compete in our usually-missed State of Oregon, so this is a very good time to ask the following question:

“How do you stand on the controversy of forced outpatient mental health drugs?”

This is my 40th year working as an advocate for people labeled “disabled,” and I know that the topic of involuntary psychiatry can be a little complicated for people. After all, if one of our beloved family members becomes irrationally self-destructive, we can become desperate for help. However, this is such an important topic that we need to go deeper than just a bumper-sticker answer.

So, let us find out where the candidates for President stand: Are you listening Hillary, Bernie, Donald, Ted, and John?

The past few years I have been working a bunch in disability advocacy, one of the biggest social change movements in human history. How we treat the most vulnerable people in a group can be very revealing.

Let me explain a little background in brief:

For many decades, almost all USA States have been quietly passing laws that allow court-ordered involuntary mental health care, that is, of people living out of institutions in the community, often in their own homes or group homes.

Sponsors of these “involuntary outpatient commitment” laws use a more euphemistic phrase: “assisted outpatient treatment” laws. “Assisted?” Sure, the way Donald Trump is “assisting” Muslims by seeking to ban them in a bigoted way. The way bigots in Bangladesh recently “assisted” a gay rights activist by killing him.   

To put it very simply: This is court-ordered coerced drugging, using a variety of methods for enforcement, sometimes even a daily visit to the person’s home.

There is a Congressperson, Rep. Tim Murphy (R-PA), who for years has been pushing a huge bill that has a section for national, federal incentives for more of this involuntary outpatient care. This Murphy Bill, HR 2646, is enormous, weighing in at 173 pages, but the worst part would be a national program for more forced outpatient psychiatry. If his bill — which he calls “Helping Families in Mental Health Crisis Act” — passes then thousands of more American citizens would have court-ordered psychiatric drugs administered to them, even though they are living out in the community, many even in their own homes!

Last year I asked one of the bill co-sponsors how many Americans they want to forcibly treat? After all, some of these zealots claim that 11 million Americans need but are not getting psychiatric care. Are you one of these 11 million? Unfortunately, the co-sponsor has stayed silent about how many citizens they are going after.

Every Person Ought to Oppose the Murphy Bill!

As far as I know, every group in the USA speaking for mental health consumers opposes increasing coerced care out in the community. There are far better ways to help people.

This Murphy bill is the worst I have seen in my 40 years of mental health advocacy. Many of us in this field are terrified and working hard for years to stop this type of care!

So where do the people running for Democratic and Republican nomination for President stand about this issue?

Note that a Republican congressperson is pushing this bill, even though Rep. Murphy claims he is for “small government.” A surprising number of congresspeople have co-sponsored this bill, even some who are considered progressive, such as my own Democratic congressperson, Rep. Peter Defazio.

Bernie and Friends: Where Do You Stand?

For more than a month, one of the main psychiatrists to publicly back Bernie Sanders for President has been asking one of the Bernie campaigners, Nick Carter, about Bernie’s position. You see, Bernie opposes certain regulations of firearms because Vermont, his home state, is so pro-gun. The National Rifle Association opposes gun regulation partly by claiming that better mental health care is the solution. So asking Bernie for his position is reasonable. Unfortunately, Bernie and Mr. Carter have apparently stayed silent.

The silence about this important topic is deafening. We need to insist on an answer from everyone. A few years ago, I saw something similar happen with Ralph Nader, who was referring mental health questions to his friend, Doctor Sidney M. Wolfe, who I know from personal experience has a terrible position about forced psychiatry. Let us stop throwing our folks under the bus, whether that is a Republican bus or a Democratic bus.

To show you how bad this can get, incredibly a few years ago when I directed the nonprofit MindFreedom International, we surfaced two people who received court-ordered involuntary outpatient ELECTROSHOCK. I would not blame you if you did not believe me. To provide evidence for this, you can google these phrases:

When courts order forced drugging this can be very racist, because white doctors and white judges tend to disproportionately target African Americans and other minorities. You can read more about this here:

Many of us wonder why our society is not showing more passion and more creativity in the face of climate crisis. Centuries of targeting our people may be one of the reasons that the population is so conformist right now, when we should have a revolution.
